Reconceptualizing freedom of fishing in the high seas under ecological justice frameworks

Abstract


The freedom of fishing on the high seas is a right that applies to all states, both coastal and land-locked states. However, freedom of fishing as regulated in 1982 UNCLOS does not provide a sense of justice for the international community and does not even guarantee the sustainability to fish on the high seas. Although international fisheries law and RFMOs have been established, over-exploitation of fisheries in the high seas still occurs and is increasingly widespread. In environmental and natural resources management, eco-centrism environmental ethics need to be enforced and formulated within the framework of ecological justice. Freedom of fishing on the high seas does not cover intergenerational justice and intragenerational justice, and thus inconsistent with the principle of justice and principles of international law from the perspective of ecological justice.
